Terms & Conditions For Bookings

Pentire Holidays the "Agents", act only as Agents for the owners of the property, "the Owners".

Clients applying to book a property are referred to as "The Tenants".

Any contract is between the Tenants and the Owners, who are responsible for providing the property to the Tenant in the appropriate condition. The names and addresses of the Owners can be provided on request. The Agents act only as agents for the Owners and are not Principals.

Your booking and Payments

Bookings will only be accepted on receipt of a completed booking form and follow the “size & party" conditions below. Payment of 30% of the cost of the holiday if more than six weeks before the start of the rental, (excluding the good housekeeping bond) is due within 5 working days. The Tenants are liable for the outstanding balance, six weeks before the start of the tenancy.

If a booking is made six weeks or more before the tenancy is due to start it must be accompanied by a deposit of 30% of the total cost of the booking.

If a booking is made less than six weeks before the start of the holiday, the full rent must be paid at the time of booking. Payments are accepted by BACS.

Rental rates quoted, are for 4 people using 2 bedrooms. A sofa bed is available for 2 additional guests at an additional cost.

Any charges raised against the Agents by their bank for handling any form of payment, or charges for dishonoured cheques, or charges for overseas transfers, will be passed onto the Tenants who are liable to reimburse the Agents within 7 days of notification.

Conditions of Size & Party

The person who books the holiday, must be:-

  • A member of the occupying party be 25yrs old or over
  • Read and agree to the Terms & Conditions of Booking.
  • List names of all those who will be occupying the property during the booking Including any additional invitees to the property including those substituted or included at a later date.
  • He or she agrees to take responsibility for the party occupying the property.

Unless expressly agreed in advance by the Agents, no group bookings (four or more adult party members) are accepted where all party members are under 25 years of age. Unless, expressly agreed in advance by the Agents, no group bookings are accepted where all members are of the same sex, unless the group consists of members of the same family across a number of generations. The Owner and Agent reserve the right to refuse access to the property without compensation where no agreement has been given in advance.

The Tenancy

The Tenancy confers upon the Tenants the right to occupy for a holiday within the meaning of schedule 1, Paragraph 9 of the Housing Act 1988. The Tenants agree:

  • The Occupancy of more people or guests than specified on the Booking Form and/or the number the Property holds, attempt to take up occupation;
  • Overnight guests are entertained without the Owner's express permission
  • Not to part with possession of the property or share it except with members of the party as shown on the booking form.
  • To pay for any losses or damage to the property however caused (reasonable wear and tear excepted)
  • To leave the property in the same state of cleanliness which it was found at the commencement of your holiday. Any extra cleaning over and beyond what is considered to be normal, will be charged to the Guest and deducted from the 'Good Housekeeping bond'.
  • To permit the Owners and Agents reasonable access to the property.
  • Not to cause an annoyance or become a nuisance to occupants of adjoining premises. To keep noise between 11pm and 7am to a minimum e.g. playing or use of any musical instrument, television, loudspeaker or any other noise making instrument to cause nuisance or annoyance to other occupants or neighbours.
  • Not to use the property for any commercial purposes.
  • Common parts of the building not to be obstructed

The Tenants right to occupy the property may be forfeited without compensation, or an additional charged levied if any of the above terms are broken.

Amendments

Alterations to confirmed bookings will be subject to a £20.00 administration charge.

To safeguard against cancellation charges and other unforeseen circumstances we strongly recommend Cancellation Insurance. Pentire Holidays DO NOT provide Holiday Insurance Cover.

Cancellation

If cancellation of a booking is made six weeks or more before the tenancy is due to start, the deposit will be returned. The booking fee of £20 will be retained.

If cancellation is made less than six weeks before the start of the holiday, the booking fee, deposit and balance are payable in full.

Cancellation by Us

We do not expect to make changes or cancel your booking. If for any reason beyond our control the property is not available due to fire or the property is unsuitable for letting, we will contact you by telephone immediately and refund your payment in full.

Arrival & Departure Times

Bookings commence at 3.00 pm unless otherwise notified, on the first day of your holiday and end at 10.00am on the day of departure.

Condition of Property/Inventory

Before you arrive, your property will have been cleaned and the Kitchen Inventory checked. On departure of your stay, please make a note in the breakages book (located by the Information Folder in the Hall) of any breakages, so that we can provide the next guests with all the essential equipment.

Discrepancies should be reported within 24 hours of arrival to the Housekeeper. The Inventory will otherwise be deemed to be correct.

Losses, damage or any cleaning necessary over and above normal servicing, will be invoiced to you on departure.

Pets

If we have agreed that you can bring a pet:

  • The dog must be at least 12 months old and fully house trained.
  • Well behaved and kept under control at all times.
  • Treated with a recognized flea treatment, prior to visit.
  • Are not allowed in bedrooms and must not be left unaccompanied in the property.
  • The Owner must bring the dog's bed or basket for sleeping in.
  • Any fouling in the garden, must be cleaned up and taken to a local public dog waste bin. Dog waste should not be put into the household black bin bags.
  • At the end of the holiday, all traces of the pet, must be cleaned from inside the apartment. There is a dyson available.

If you choose not to observe this rule, money will be deducted from the 'Good Housekeeping bond'. There is a charge for bringing a pet.

Linen

Bed Linen and Towels are included in the price, for stays of up to 7 nights for four guests. A charge is applied on your booking form, for linen and towels, for stays over 7 nights. All beds will be made up on arrival.

Towels (not beach towels) are included in the apartment.

The sofa bed is available for 2 additional guests, at an additional cost.

Local Recycling

During your stay in the apartment, please take responsibility for disposing of your waste, by using the recycling bag located under the sink. During your stay, the 'local sites' listed in my Information folder, accept the listed items, for you to dispose of your recycling.

There is an InsinkErator fitted, for guests to use for disposal of food waste.

Broadband

This has unlimited availability.

Fuel costs

All gas and electricity costs are included in the booking price.

Smoking

No smoking is allowed in the building. No candles of any kind, to be used.

Parking

Parking instructions must be adhered to. Any vehicle and contents are parked entirely at your risk.

Outside areas

Feeding of Seagulls is prohibited by the Council and not permitted on site.

Washing not to be hung outside.

In the event of breach of these terms and conditions the Tenants may be required to leave the property during the period of the booking.

Damage to Property

The Tenant is liable for the full cost of any damage caused to or within the property during the letting.

By accepting these terms and conditions you agree to us taking payment for any damages from the 'good housekeeping' bond.

Any further payments above the 'good housekeeping bond' will be paid by the Tenant if required.

Liability

The Agents do not accept liability for any act, neglect or default on the part of the Owner or any other person not within their employ, nor for any accident, damage, loss injury, expense or inconvenience whether to person or property, which the Tenants or anyone connected with the letting may incur.

If for any reason beyond the Owner's control the property is not available on the date booked (owing to fire damage for example) or the property is unsuitable for holiday letting, all rent and charges paid in advance by the Tenants will be refunded in full, but the Tenants shall have no further claim against the Owner or Agent.

Disclaimer

All properties are used at your own risk. Parents should ensure that their children are supervised in such areas at all times.

Governing Law & Jurisdiction

The contract is deemed to have been made Heathlands Cottage Street Lane, Scholar Green, Stoke-on-Trent ST7 3SN. The validity, construction and performance of this Agreement shall be governed by English Law. The Tenants submit to the exclusive jurisdiction of the English Courts.

Complaints

All complaints must be notified to the Owner or their designated property manager immediately to ensure sufficient time is given to investigate and/or take the necessary remedial action. Compensation will not be offered where the Tenants have denied the Agents or the Owners the opportunity to rectify matters during holiday.
